I advise on all trusts of land issues, including among other matters the operation of specific terms in express trusts of land; the protection of equitable interests in land at the Land Registry; co-ownership disputes about entitlement to occupy land, liability for costs and expenses, distribution of rent and profits, and occupation rent. I advise trustees and beneficiaries on the effects pf Part 1 of ToLATA 1996, including the removal of trustees, children in occupation of trust land, and the interests of secured creditors. I have very extensive experience in the field of informal creation of trusts in land: that is, resulting and constructive trusts in family relationships and in the business context. This includes disputes between business partners, property purchases made by parents and children together, and property developers who are also linked by friendship or family ties. In the family context, I am also experienced in acting for and advising clients in applications under Schedule 1 of the Children Act 1989 combined with ToLATA claims.
I have a general referral practice advising trustees on their duties and obligations; advising on the nature and effect of provisions in trust deeds, and about distribution and accumulation. I act for both trustees and beneficiaries in relation to actual or potential breaches of trust. I am experienced in all forms of equitable remedies including rectification of documents, tracing, estoppels, rescission and subrogation, and restitutionary remedies such as unjust enrichment. I also advise and represent clients in implied trust claims over monies in bank accounts and other bare trusts.
Non-contentious probate: I advise executors, personal representatives and their solictors on the interpretation of specific provisions in a Will or the operation of the intestacy rules. I also advise executors (often at short notice and to a deadline) about queries or problems relating to the probate process or the administration of an estate.
Contentious probate: I act in applications to the Court to remove executors and personal representatives for breaches of duty, in challenges to Wills on the basis of lack of due execution, want of knowledge and approval, lack of testamentary capacity, and undue influence. In relation to want of knowledge and approval/lack of testamentary capacity, I have a particular interest in cases involving dementia.
Inheritance (Provision for Family and Dependants) Act 1975: My experience in I(PFD)A 1975 Act cases is extremely extensive, and I can only give a flavour of it here. I have acted for a wide range of claimants including infant children, spouses widowed after long marriage, adult children, s.1(1)(e) dependants and cohabitees, in disputes involving complex estates of all kinds. Recent work has included estates with elements of equitable joint tenancy, partnership, assets in the name of a limited company, agricultural land and development land.
I am regularly instructed in financial remedy cases, in particular in those cases where there are substantial inherited assets or assets acquired before the marriage, and/or where third parties are making a claim to matrimonial assets -- for example, by claiming a constructive trust in their favour. My long familiarity with constructive trusts means that I have a skill set ideally suited to dealing with the concepts recently set down in the Supreme Court judgment of Petrodel v Prest.
I am a real property lawyer by background and training; I was for seven years a member of the property team at 11 Stone Buildings, Lincolns Inn.
I continue have a busy practice in this area of law and I deal with the full range of real property issues. I regularly advise on commercial leases; on easements; on restrictive covenants; and on all kinds of land registration issues. I am able to act as an on-call resource for quick advice on conveyancing or completion problems. My particular interests are the law of mortgage and the connection between mental capacity and the disposition of property. More recently, I have also developed a practice advising on the use, occupation and valuation of agricultural land. I am experienced in representing applicants and respondents in injunction applications over a wide range of land disputes.
Land litigation is one of the areas in which public direct access to the Bar is particularly useful and cost-efficient. SME developers, landlords and non-professional trustees of land, to name but a few, can go directly to an experienced trial advocate when litigation seems likely, and obtain advice, drafting of documents and representation, without the necessity of having to instruct a solicitor as well. Court of Protection: I advise on issues involving property and affairs deputies under the Mental Capacity Act, including contemplated or actual applications for the removal of a Deputy, and on avoidable dispositions.
I specialise in dealing with median-range trusts and estates, where the assets are significant but costs are a vitally important factor.
